Prenuptial and Post Nuptial Agreements

Separation Agreements
New York law has precise requirements for a Separation Agreement, which can convert to a no-fault divorce after one year. We’ll craft an agreement that works for both sides and includes the necessary language so it can be converted economically to a no-fault divorce.
Divorces
Our Saratoga Divorce Lawyers are experienced on both no-fault and at-fault divorces. No-fault divorce is the most cost-effective way to obtain a divorce. In order to obtain a no-fault divorce, the parties need to have lived in New York for at least one year. A no fault divorce can also be granted if there are no children, the parties agree to property division, and the relationship has been irretrievably broken for six months.
At-fault divorces can be the most expensive and time-consuming divorce process, if the at-fault party seeks to challenge these claims in a lawsuit. At-fault divorces require proof of misconduct by one of the spouses. Severe and cruel treatment, abandonment, imprisonment, or adultery are among the grounds for an at-fault divorce.

A New York court can issue orders about a child’s custody only if the child is under 18. The Court grants custody based on the best interest of the child.
