ALBANY, NY (WRGB) — An Albany man appeared in Albany County court Tuesday morning over two years after he was arrested.
Eric Frazier, 56, was arrested in June 2022 for attempted murder and aggravated assault of a police officer.
It all happened on June 20, 2022, when officers responded to a domestic violence call on Franklin Street.
During that response, officers learned Frazier had an outstanding warrant for a different criminal charge where he choked another woman. It was then an altercation broke out and Fraizer is seen on body camera video attempting to stab an officer.
CBS6 asked the district attorney’s office why it took more than two years for Frazier to finally go before a judge.
“As far as the delay in the case, a significant amount of work needed to be done on the front end before we proceeded with the indictment,” said the DA’s Office.
We reached out to legal experts from Tully Rinckey to ask how common this delay was in a case like this.
“I mean, generally speaking, they will wait until they have enough evidence to bring a charge,” said Matt Winchell, partner at Tully Rinckey. “They don’t want to bring anything too prematurely. So I would say that generally speaking, it’s, you know, they do collect the evidence before they bring charges.”
