Attorney weighs in on prosecuting difficult-to-track school threats

ALBANY, NY (WRGB) — CBS 6 continues to look into the threats being made across our local school districts, with the latest impacting Schenectady High School.

Thursday morning, a post on the school district’s Instagram account referenced an online threat regarding the high school. The post notes there have been similar posts across the state, and local and federal authorities are working to find the source.

This comes after days of disruption in the Bethlehem Central School District, after threats were phoned in there.

In that case, investigators have said the threats appear to be part of a “swatting hoax,” meant to provoke a response from law enforcement.

One theory is that artificial intelligence could be playing a role in these cases.

We once again spoke with attorney Nicholas Marricco of Tully Rinckey PLLC to get his thoughts on these latest threats:

“As long as the prosecution can show at trial that the perpetrators are the ones who initiated the phone calls, it really shouldn’t be a problem – it shouldn’t be that difficult to geo-locate the caller. That could be done through subpoenas – it would become difficult for local law enforcement if the call was made outside the jurisdiction,” Marricco tells CBS 6.
