With some thirty years of experience in all facets of litigation, Steven L. Herrick, Esq., Managing Partner of Tully Rinckey PLLC’s office in the heart of Washington, D.C.’s Golden Triangle, provides representation to clients across a broad spectrum of employment-related matters, including adverse action, whistleblower and other types of retaliation, servicemember employment and reemployment rights under USERRA, veterans preference rights under the VEOA, claims under the Family Medical Leave Act, and
discrimination based on race, gender, age, and disability.

Steve practices before Federal, State and District of Columbia courts, the Merit Systems Protection Board (MSPB) and the Equal Employment Opportunity Commission (EEOC) as well as representing clients in arbitration, mediation and agency proceedings.

Steve’s commitment to representing servicemembers, veterans, and the federal workforce comes following his son’s deployment to Iraq. When he joined Tully Rinckey PLLC in March 2006, he found a firm that shared this commitment. He managed the firm’s Corporate, Commercial and Municipal litigation practice for two years, continuing a thriving business practice, while at the same time beginning his transition into the area of employment law. This transition accelerated two years later when Steve moved to Washington to manage the firm’s office on K Street, N.W. Although Steve continues to handle business litigation for the firm, the lion’s share of his practice is now devoted to Federal and military employment rights and benefits.

Prior to joining Tully Rinckey PLLC, Steve served as partner with the full-service Long Island law firm of Farrel, Fritz, P.C. As co-head of the firm’s sophisticated Commercial Litigation Department, he represented many high-profile clients in complex matters, conducting numerous trials and frequently arguing cases in the appellate courts. Thereafter, Steve formed his own firm in 1991, where he continued his successful litigation practice first on Long Island, and then in the Albany area.

After graduating with honors from Tufts University, Steve earned his law degree from the prestigious University of California, Berkeley (Boalt Hall) School of Law. Following law school, Steve served as Confidential Secretary to the Justices of the Appellate Division, Second Department, a state appeals court, for whom he prepared case memoranda and opinions on both appeals and motions.

Steve is a member of the bars of Washington, D.C. and New York and is admitted to practice in the United States Courts of Appeals for the Federal, District of Columbia and Second Circuits and the United States District Courts for the Northern, Southern and Eastern Districts of New York. He has been admitted pro hac vice to practice in specific matters in courts from Virginia to California.

Steve was selected to as the 2009 legal columnist for the Washington Business Journal. His “Capital Counsel” column provides legal advice to employers and employees attempting to navigate the complex rules and regulations of the workplace. He has been interviewed by various media outlets regarding employment law matters, including the National Law Journal, Government Executive, and Federal Daily.

Steve is a past member of the Judicial Officer Screening Committee for the Tenth Judicial District in New York. He has lectured on New York civil practice at both professional associations and law schools and is a former adjunct professor of New York practice at Touro Law School. For more than a decade, Steve served as a director and officer, including six years as President, of Harbor Child Care, Inc., a nationally accredited not-for-profit provider of child care services for both communities and organizations such as North Shore University Hospital and Cablevision. He is a semi-retired modified fast pitch softball player (over 50 only, please) and a definitely retired high school soccer referee.

Steve and his wife Beth are enjoying a return to city living in their apartment in the District from which neither has to drive to work. Beth, a Masters level Social Worker, works in palliative care at The Washington Home and Community Hospices and is a certified Master Gardener. Their daughter Molly, completely ignoring her college curriculum, is a research analyst at a major commercial real estate firm. She lives in the same Oakland, California, neighborhood as Steve did when he was in law school. Beth and Steve’s son, Sgt. Andrew Herrick, received his medical discharge from the U.S. Army after a four and one-half year tour as a combat infantryman. He is now enrolled in the air traffic controller program at Arizona State University thanks to the G.I. Bill for the 21st Century. Andrew’s experiences have reinforced Steve’s commitment to serve the legal needs of servicemembers, especially disabled veterans.
